Apostille vs Notary: Understanding the Key Differences

Notarization and apostille do different jobs. A notary performs a particular notarial act, such as taking an acknowledgment or administering an oath. An apostille authenticates the origin of an eligible public document for use abroad where the Apostille Convention applies. Some documents need both steps; others do not need notarization at all.

Do you need a notary, an apostille, or both?

Start with the receiving organization’s written instructions. Tell us the document type, where it was issued, the destination country or territory, and your deadline. That information helps identify the preparation and issuing authority before you pay for unnecessary steps.

Birth and marriage certificates: use an official certified record

A Massachusetts birth or marriage certificate generally follows the certified-record route. Obtain the appropriate certified copy from the issuing records office. Do not replace that record with a notarized photocopy. Massachusetts does not authenticate notarized copies of government-issued documents. The eligible public official’s signature is the relevant starting point.

This corrects a common misunderstanding: a birth certificate does not first have to be notarized simply because it needs an apostille.

Affidavits and powers of attorney: notarization may come first

A privately prepared affidavit or power of attorney may need an appropriate notarial act before certification. Bring the complete document and the recipient’s signing instructions. Do not assume that a stamp alone satisfies those instructions.

An acknowledgment and a jurat are different acts. An acknowledgment concerns the signer’s acknowledgment of voluntary execution; a jurat includes an oath or affirmation and signing in the notary’s presence. Ask the document preparer or receiving organization which act is required. A notary does not decide the legal effect of your document.

Diplomas and transcripts: confirm the school format

Ask your receiving institution whether it requires a registrar-certified diploma or transcript, a notarized copy, a sealed record, or direct delivery from the school. These formats are not interchangeable. Confirm the requested format before arranging notarization, campus pickup or apostille processing.

State documents and federal documents use different authorities

The appropriate authority depends on the document’s origin. Massachusetts certifications concern eligible Massachusetts official or notarial signatures. Federal documents, including FBI background reports, follow the applicable federal process. Sending every document to the same office can create delays.

What an apostille actually certifies

An apostille concerns the document’s origin: the relevant signature, the signer’s official capacity, and the seal or stamp. It does not establish that every statement in the document is true, approve its legal effect, or guarantee that a school, court or other recipient will accept it for a particular purpose.

When authentication or legalization needs review

If the Convention does not apply to your situation, a different authentication or legalization route may be required. Country membership alone is not enough to decide every case: effective dates, objections, territories and document scope can matter. Confirm the applicable route before submitting documents.
